Digital rights are human rights and rights that enable individuals to access, use, create, and publish digital media or to admission and use computers, other electronic devices, and telecommunications networks. This concept particularly relates to protecting and enforcing existing rights, such as the right to privacy and freedom of appearance, in digital technologies, especially the Internet. The laws of various countries recognize the right to access the Internet.
Main laws by location
Several countries and unions have laws on digital rights:
- Costa Rica: The Costa Rican Supreme Court judgment of July 30, 2010, granted the fundamental right to access digital technologies, particularly the Internet.
- Estonia: In 2000, Parliament launched a significant program to extend Internet access to rural areas, arguing that it was essential for life in the 21st century.
- European Union: The Charter of Digital Rights was adopted in 2023.
- Finland: According to the Ministry of Transport and Communications, by July 2010, every inhabitant of Finland should have access to broadband with a speed of 1 megabits per second. And by 2015, access to a connection with a capacity of 100 Mbit/s.
- France: In June 2009, the Legitimate Council, France’s highest court, recognized Internet access as a fundamental human right in a harshly worded decision. With this sharply worded decision, parts of the HADOPI law remained repealed, which would have allowed the prosecution to apprehend the perpetrators without legal recourse. Check and automatically block network access for people who have continued downloading illegal material after two warnings.
Global Network Initiative (2008)
On Oct. 29, 2008, the Global Network Initiative (DNB) remained founded based on its “principles of freedom of expression and confidentiality”.Launched to spot the 60th anniversary of the Universal Declaration of Human Rights (UDHR), the initiative builds on internationally recognized human rights laws and standards relating to freedom of expression and privacy, as set out in the UDHR, the International Covenant on Civil and Political Human Rights, rights are defined.
(ICCPR)) and the International Covenant on Economic, Social, and Cultural Rights (ICESCR). The initiative’s participants include the Electronic Frontier Foundation, Human Rights Watch, Google,
Microsoft, Yahoo, other major corporations, human rights NGOs, investors, and academics. John Harrington opposed DNB’s influence as a voluntary code of conduct, calling for the law to oblige boards to take responsibility for human rights instead.
